of License Application
Dear Mr. Josten:
On October 31, 2006, the Commission granted your request to convert your exemption application to a license application.[1] In that order, the Commission directed the Director, Office of Energy Projects, to issue a letter identifying any additional information required to conform your exemption application to the licensing regulations and to allow you 90 days from the date of the letter to provide such information.
By letter dated November 8, 2006, we provided you with a list of information that was required for a license application and additional information under sections 4.38 and 4.61 of our regulations needed to process your license application. That information was due no later than February 6, 2007.
On February 5, 2007, you provided three of the eight requested items of information, and requested an extension of time of 60 days for four of the items and 120 days for the cultural information. By letter dated March 15, 2007, we granted you extensions of time until May 14 and August 20, 2007, respectively.
On May 15, 2007, you provided some of the non-cultural information. That filing, however, did not adequately respond to our request. On June 13, 2007, we outlined the deficiencies and granted you an extension of time until August 20, 2007, to correct the identified deficiencies and file all the requested information.
Your response to our June 13 letter was due over 2 weeks ago. Thus far, you have not provided any of the outstanding information. Consequently, we are dismissing your application.
